1. About these Terms
These Terms of Service and Terms & Conditions ("Terms") govern your use of the websites, online platforms, donation facilities, fundraising pages, events, merchandise facilities and other services operated by Collective Aid Charitable Foundation ("Collective Aid", "we", "us" or "our").
Collective Aid is a charitable organisation registered in England and Wales under charity number 1206028.
By using our website, making a donation, purchasing merchandise or tickets from us, creating or participating in a fundraising activity, signing up to receive communications from us, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our services. These Terms should be read together with our Privacy Policy and, where relevant, our Refund and Return Policy.

3. Use of our website and services
You agree to use our website and services only for lawful purposes and in a manner that does not:

We reserve the right to suspend or restrict access to our website or services where we reasonably believe that these Terms have been breached or that doing so is necessary to protect our organisation, supporters, beneficiaries, staff, volunteers or third parties.
4. Donations
4.1 Charitable donations
Donations made to Collective Aid are voluntary charitable contributions intended to support our charitable objectives and activities. Unless expressly stated otherwise, a donation does not constitute payment for a particular product, service or benefit. We may use donations in accordance with our charitable objectives and our operational and funding priorities.
4.2 Restricted and designated donations
Where we invite donations for a particular campaign, programme, emergency appeal or charitable purpose, we will make reasonable efforts to apply the funds in accordance with the stated purpose. However, circumstances may change. If we receive more funds than are reasonably required for a particular appeal, campaign or project, or if it becomes impracticable, impossible, unlawful or inappropriate to use funds for the stated purpose, we may use those funds for another charitable purpose consistent with our charitable objectives. Where appropriate, we may also apply funds to the costs reasonably associated with delivering the relevant charitable activity.
4.3 Donation processing
Online donations may be processed through third-party payment and fundraising platforms, including Fundraise Up, Stripe, Paypal and CAFDonate or other payment providers we may use from time to time. Your use of those payment services may also be subject to the terms and privacy policies of the relevant provider. We do not normally receive or store complete payment-card information. Payment information is generally processed by our payment and fundraising providers in accordance with their own security and compliance requirements. Fundraise Up states that Stripe handles PCI payment data for donations processed through its platform and that Fundraise Up generally retains only limited payment information such as the last four digits of a card for relevant purposes.
4.4 Donation receipts
Where applicable, we will provide a donation confirmation or receipt using the contact information supplied by the donor. Donors are responsible for ensuring that the information they provide is accurate. If you believe a donation receipt contains an error, please contact us through our contact page.
5. Recurring donations
Where recurring donations are available, you authorise us and/or our payment provider to process the donation at the frequency and amount selected by you. You may cancel a recurring donation by using the cancellation functionality provided by the relevant donation platform or by contacting us. Cancellation will normally prevent future donations from being taken but will not automatically reverse donations that have already been processed. If you believe that a recurring donation has been taken incorrectly, please contact us promptly so that we can investigate.
6. Fundraising
You may be permitted to create or participate in fundraising activities supporting Collective Aid. Where you fundraise on our behalf, you agree to:
represent Collective Aid accurately and honestly;
comply with applicable fundraising laws and regulations;
use funds only for the purpose for which they were raised;
avoid making promises or representations about Collective Aid that have not been authorised;
not imply that you are an employee, trustee or authorised representative of Collective Aid unless you are;
protect the privacy and dignity of people represented in fundraising materials;
obtain appropriate permissions for photographs, videos, testimonials and other third-party material; and
comply with any specific fundraising guidance we provide.
We reserve the right to withdraw permission for a fundraising activity where we reasonably believe that it may harm Collective Aid, its service users, supporters, team members, volunteers or reputation.
7. Merchandise and other purchases
Where Collective Aid sells merchandise or other goods, the purchase of those goods constitutes a transaction separate from a charitable donation. Product descriptions, prices, availability and delivery information will be provided at the point of sale where applicable. We reserve the right to correct pricing or description errors and to cancel an order where an obvious error has occurred. Consumers purchasing goods from us retain any mandatory statutory rights that cannot lawfully be excluded or restricted by these Terms. Returns and refunds for merchandise and other purchases are governed by our Refund and Return Policy.
8. Events and tickets
Where Collective Aid sells tickets for events, the terms applicable to the particular event will be displayed at the time of purchase. Unless otherwise stated, event tickets are non-transferable and non-refundable except where a refund is required by law or where Collective Aid expressly agrees otherwise. If Collective Aid cancels or materially changes an event, we will communicate the available options to ticket holders as soon as reasonably practicable.
9. Intellectual property
Unless otherwise stated, the content published on our website and through our official platforms, including text, graphics, logos, photographs, videos, reports, publications, designs and other materials, is owned by or licensed to Collective Aid. You may access and use our materials for personal, non-commercial purposes and may share links to our publicly available content, provided that you do not misrepresent the source or alter the material in a misleading manner. You must not reproduce, sell, commercially exploit, modify or distribute our content without our prior written permission, except where permitted by applicable law.
10. User-generated content
Where we allow you to submit or publish content, including photographs, videos, comments, testimonials, fundraising stories or other material, you remain responsible for that content. By submitting content to us, you confirm that:
you have the necessary rights and permissions to submit it;
it does not unlawfully infringe another person's rights;
it is not defamatory, fraudulent or otherwise unlawful; and
where it contains identifiable people, you have obtained any permissions required for the intended use.
You grant Collective Aid a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and distribute submitted content for our charitable, fundraising, communications, educational and reporting purposes, subject to applicable privacy and data protection law. Where appropriate, we may contact you separately regarding specific uses of your content.
11. Safeguarding and dignity
Collective Aid is committed to protecting the dignity, safety, privacy and rights of the people with whom we work. Content involving service users, refugees, migrants, displaced people, children or other potentially vulnerable people may be subject to additional safeguarding, consent and privacy requirements. We reserve the right to remove or decline content where we believe publication could create a safeguarding, privacy, security or reputational risk.
12. Links to third-party websites
Our website may contain links to third-party websites, services or organisations. We do not control those websites and are not responsible for their content, availability, security, privacy practices or terms. Your use of a third-party service is subject to that provider's own terms and policies.
13. Third-party platforms
We may use third-party providers to deliver aspects of our services, including fundraising, payments, communications, hosting, analytics, event management and other operational functions. Examples may include Fundraise Up, Stripe and other providers selected by Collective Aid from time to time. Those providers may have their own terms and policies, which may apply to your use of their services.
14. Website availability and accuracy
We aim to ensure that information published by Collective Aid is accurate and up to date. However, we cannot guarantee that all information will always be complete, accurate, current or error-free. Our website and services may occasionally be unavailable due to maintenance, technical problems, security incidents or circumstances outside our reasonable control. We reserve the right to modify, suspend or discontinue any part of our website or services without prior notice where reasonably necessary.
15. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. Subject to that limitation, Collective Aid will not be liable for indirect, incidental, special or consequential loss arising from your use of our website or services where such liability cannot reasonably be attributed to Collective Aid's breach of these Terms. We are not responsible for losses caused by circumstances outside our reasonable control, including failures of third-party payment processors, hosting providers, telecommunications networks or other external systems.

To the extent permitted by law, you agree to reimburse Collective Aid for reasonable losses, liabilities, costs or expenses arising directly from your unlawful use of our services, fraud, deliberate misconduct or material breach of these Terms.
